1. Introduction

These Terms & Conditions govern your rental of equipment (“Equipment”) from Watersports Now, LLC (“we,” “us,” “our”). By booking or using our Equipment, you agree to these terms.

2. Booking & Payment

  • Reservation: A valid credit card is required to hold any booking.
  • Payment: Full payment is due at booking unless otherwise agreed in writing.
  • Taxes & Fees: Applicable sales tax and fees are added at checkout.

3. Cancellation & Modification

  • Your Cancellation: You may cancel up to 24 hours before your rental start time for a full refund. Cancellations made less than 24 hours, no-shows or same-day cancellations are non-refundable.
  • Our Cancellation: We reserve the right to cancel or modify any booking at our sole discretion (e.g., due to unsafe weather or maintenance). If we cancel, you’ll receive a full refund or the option to rebook.

4. Use of Equipment

  • Condition & Inspection: You accept Equipment “as is.” Inspect on pickup and report any issues immediately.
  • Proper Use: Operate Equipment only as intended and in accordance with all safety instructions. You’re responsible for any damage, loss, or theft from the time of pickup until return.

5. Assumption of Risk & Waiver

You acknowledge that water sports and equipment rental involve inherent risks of injury or damage. You assume all risks and agree to release us, our officers, employees and agents from liability for personal injury, death, or property damage arising from use of the Equipment, except where prohibited by law.

6. Indemnification

You agree to indemnify, defend, and hold harmless Watersports Now, LLC, its managers, employees, and agents from any and all claims, damages, losses, and expenses (including attorney’s fees) arising out of your use or misuse of the Equipment.

7. Limitation of Liability

To the fullest extent permitted by Florida law, our liability for any claim related to Equipment rental shall not exceed the total rental fee you paid. We are not liable for indirect, incidental, or consequential damages.

8. Governing Law

These Terms are governed by the laws of the State of Florida. Any dispute must be brought in state or federal courts located in Pinellas County, Florida.
