1. Introduction

These Terms & Conditions govern your rental of equipment (“Equipment”) from Watersports Now, LLC (“we,” “us,” “our”). By booking or using our Equipment, you agree to these terms.

2. Booking & Payment

  • Reservation: A valid credit card is required to hold any booking.
  • Payment: Full payment is due at booking unless otherwise agreed in writing.
  • Taxes & Fees: Applicable sales tax and fees are added at checkout.

3. Cancellation & Modification

  • Your Cancellation: Cancel up to 24 hours before start time for a full refund. Cancellations within 24 hours, no-shows, or same-day changes are non-refundable.
  • Our Cancellation: We may cancel or modify bookings due to weather, maintenance, or safety concerns. In such cases, you’ll receive a full refund or reschedule option.

4. Use of Equipment

  • Condition & Inspection: You accept Equipment “as is.” Inspect upon pickup and report issues immediately.
  • Proper Use: Use Equipment only as intended and per all safety instructions. You are fully responsible for damage, loss, or theft from pickup until return.

5. Assumption of Risk & Waiver

You acknowledge that water sports and equipment rental involve inherent risks. You assume all such risks and release Watersports Now, LLC, its employees, and agents from liability for injury, death, or property damage arising from Equipment use (except where prohibited by law).

6. Indemnification

You agree to indemnify and hold harmless Watersports Now, LLC and its personnel from any claims, damages, or expenses (including legal fees) resulting from your use or misuse of the Equipment.

7. Limitation of Liability

To the fullest extent permitted by Florida law, our total liability shall not exceed the rental fee paid. We are not liable for indirect, incidental, or consequential damages.

8. Governing Law

These Terms are governed by Florida law. Any disputes must be filed in state or federal courts in Pinellas County, Florida.

9. Text Communications

By submitting your mobile phone number through our website contact form, you consent to receive transactional SMS messages related to your kayak rental or tour reservation.

These messages may include booking confirmations, check-in instructions, weather updates, logistical information, and customer support responses.

Message frequency varies. Message and data rates may apply.
